1) Purpose and Scope
These terms of use (the "Terms") govern access to the website immy.be and its use, including viewing and publishing real estate listings as well as connecting interested parties with advertisers (individuals or agencies). By accessing the website, you confirm that you have read and accepted these Terms. The publisher's identification information and the required mentions for an online service are published above and in our information pages, in accordance with Book XII of the Economic Law Code (CDE).
2) Platform Role
immy is a hosting and connection intermediary: we provide a publication space and contact tools. Unless otherwise indicated, we are not party to real estate transactions and do not act as a real estate agent. Advertisers remain solely responsible for the content of their listings, the accuracy of the information provided, and compliance with applicable legal obligations (e.g., information obligations, PEB, display of professional mentions).
3) Accounts and Eligibility
The service is intended for adults. You undertake to provide accurate information when creating an account and to preserve its confidentiality (credentials, password). immy may suspend or close an account in case of abusive use or violation of these Terms.
4) Publication Rules (listings and content)
You must only publish content that is lawful, accurate, up-to-date, and does not infringe third-party rights (intellectual property, privacy, image rights, etc.). The following are prohibited: misleading, defamatory, unlawful, discriminatory content, or content containing others' personal data without permission.
Real Estate (legal reminders):
- IPI agencies must display their IPI number and other required professional mentions on their materials and website; we may require these mentions to appear in profiles and listings.
- Listings must comply with energy information obligations (PEB) from the time of advertising (no "PEB in progress").
5) Content Moderation and Reporting (DSA)
immy applies proportionate and transparent moderation rules: content removal, delisting, visibility restriction, account suspension, particularly in case of manifest illegality or non-compliance with these Terms.
You can report content you believe to be unlawful or contrary to the rules by writing to us at hello@immy.be specifying the URL, content description, and reason for reporting. When content is restricted or removed, the affected user receives a reasoned notification and has access to an internal complaint procedure. Certified out-of-court settlement options may be used in addition. These mechanisms are part of the Digital Services Act (DSA): clear information on restrictions in the Terms, notice-and-action mechanism, statement of reasons, internal complaint handling system, measures against abuse.
immy is not subject to any general obligation to monitor the information it hosts, without prejudice to cooperation obligations with competent authorities.
6) Messaging and Connection
Contact details and messages exchanged via forms are transmitted to the relevant advertiser. immy may perform anti-abuse checks (e.g., spam filtering, security). Subsequent exchanges and contractual commitments are your sole responsibility.
7) Intellectual Property
The website, its structure, software, and graphic elements are protected by intellectual property law. Subject to your rights to your own content, immy grants you a limited, non-transferable, non-exclusive license to access and use the website in accordance with these Terms. By publishing content, you grant immy a worldwide, non-exclusive, free license to reproduce and represent it as necessary to host, display, and distribute it via the platform and its promotional materials.
8) Availability and Maintenance
We make every effort to ensure reasonable service availability. Temporary interruptions (maintenance, updates, security) may occur. When possible, prior notice is published.
9) Liability
To the extent permitted by law, immy assumes no liability for: (i) content provided by users/advertisers; (ii) the accuracy, quality, or completeness of information relating to properties; (iii) transactions made outside the platform. Nothing in these Terms excludes liability that cannot be excluded under Belgian law (for example in case of gross negligence or fraud). Limitation clauses must remain reasonable and not deprive parties of their essential rights.
10) Third-Party Links and Services
The website may contain links to third-party websites. immy does not exercise control over these resources and assumes no responsibility for them.
11) Personal Data and Cookies
Use of the website involves processing certain personal data; consult our Privacy Policy (immy.be/privacy) and our Cookies page to understand what data is processed, for what purposes, and your rights.
12) Payments and Professional Services (optional)
If paid options for professionals (e.g., listing packages, visibility) are offered, specific commercial conditions may apply and will be presented at the time of order. Belgian e-commerce rules and, for consumers, the 14-day right of withdrawal apply where applicable, subject to exceptions for certain digital services and services already fully performed at the consumer's express request.
Note: the European ODR/RLL platform was closed on July 20, 2025; for out-of-court settlement options in the EU, refer to the mechanisms listed by the Commission ("Consumer Redress in the EU").
13) Modification of Terms
We may modify these Terms to reflect changes to the service or legal framework. In case of significant change, a notification will be published on the website and/or sent by email; the update date appears at the top of the document. For content-related restrictions, immy applies the clear information requirements provided by the DSA.
14) Applicable Law and Jurisdiction
These Terms are governed by Belgian law. In the absence of an amicable agreement, any dispute will be brought before the competent courts of the district of Nivelles (Walloon Brabant), without prejudice to mandatory rules protecting consumers (jurisdiction of the domicile forum and remedies provided by law). Belgian rules on e-commerce and consumer information apply.
